1. Purpose of this Policy

MyDaycare Plus is management software designed for childcare services. It is operated by Every8 Cloud Inc. , hereinafter referred to as E8C .

This Privacy Policy explains how personal information is processed, used, disclosed, retained and protected in connection with the use of MyDaycare Plus .

It applies to the website, web application, mobile applications, modules, integrations, support services and artificial intelligence features of MyDaycare Plus .

This Policy forms an integral part of the Terms of Use of MyDaycare Plus .

2. Role of E8C

Childcare services use MyDaycare Plus to manage their operations and data.

The information contained in MyDaycare Plus is primarily entered, imported or transmitted by childcare services and their authorized users.

The childcare service determines, in particular:

  • what information must be entered;
  • why the information is used;
  • who may access it;
  • how long it must be retained;
  • what communications must be made.

In this context, E8C processes the information on behalf of the childcare service in order to provide and operate MyDaycare Plus .

E8C does not directly collect information from children or parents in the normal course of using MyDaycare Plus . This information is provided and managed by the childcare service.

E8C is, however, responsible for the information it collects directly to manage its own activities, including customer accounts, subscriptions, billing, commercial communications, technical support and Service security.

3. Information Processed

MyDaycare Plus stores the information required to operate the Service and provide the features used by the childcare service.

The nature of the information depends on the activated modules and the data entered or imported by users.

This information may be required to manage:

  • accounts and users;
  • children’s records;
  • parent and guardian records;
  • employee records;
  • attendance;
  • schedules;
  • communications;
  • documents;
  • photographs;
  • billing;
  • payments;
  • banking information;
  • service agreements;
  • educational records;
  • medical information;
  • payroll;
  • tax documents;
  • reports;
  • integrations;
  • artificial intelligence features.

MyDaycare Plus may also store technical information required for the operation and security of the Service, including login dates, activity logs, technical errors, IP addresses, devices used and operations performed.

E8C limits the processing of information to what is reasonably necessary to provide the Service and perform the requested features.

4. Sources of Information

The information processed in MyDaycare Plus comes primarily from:

  • childcare services;
  • users authorized by childcare services;
  • imported files;
  • systems connected by the childcare service;
  • operations performed in MyDaycare Plus ;
  • support requests submitted to E8C .

The childcare service may import information from another software application, file or external system.

5. Use of Information

Information is used to:

  • create and administer accounts;
  • authenticate users;
  • apply roles and access rights;
  • provide requested modules and features;
  • store and display data;
  • produce reports and documents;
  • manage attendance, schedules and records;
  • manage billing, payments and payroll;
  • send requested communications and notifications;
  • perform activated integrations;
  • provide artificial intelligence features;
  • provide support;
  • maintain the security and integrity of the Service;
  • prevent errors, abuse and fraud;
  • comply with legal and contractual obligations.

E8C may also use technical, aggregated, anonymized or de-identified information to improve the performance, security, interfaces and features of MyDaycare Plus .

This information must not be used to directly identify an individual.

6. Responsibilities of the Childcare Service

The childcare service is responsible for the information it enters, imports, uses or asks E8C to process through MyDaycare Plus .

It must, in particular:

  • have the right to collect and use the information;
  • inform the individuals concerned when required;
  • obtain the necessary consents;
  • limit collection to the information that is necessary;
  • keep the information accurate and up to date;
  • provide access only to authorized individuals;
  • manage roles and permissions;
  • disable access that is no longer required;
  • establish its retention rules;
  • respond to requests from the individuals concerned;
  • comply with applicable laws.

The childcare service must not enter information into MyDaycare Plus that it is not authorized to collect, use, retain or disclose.

7. Access to Information

Information contained in MyDaycare Plus is accessible only according to the roles and rights configured by the childcare service.

The childcare service is responsible for determining which users may access the different information and features.

Authorized E8C personnel may access information only when reasonably necessary to:

  • provide support;
  • resolve a problem;
  • perform a technical intervention;
  • maintain the security of the Service;
  • comply with a legal obligation.

Access by E8C personnel is limited to individuals who require it to perform their duties.

8. Service Providers

E8C may use service providers to operate certain parts of MyDaycare Plus .

These providers may offer services related to:

  • hosting;
  • backups;
  • security;
  • notifications;
  • email services;
  • payment processing;
  • electronic signatures;
  • technical support;
  • performance monitoring;
  • artificial intelligence.

For each provider, E8C limits disclosure to the information strictly necessary to provide the relevant feature or service.

Providers are subject to confidentiality and security obligations appropriate to the nature of the information processed.

E8C does not sell or rent information contained in MyDaycare Plus for advertising purposes.

9. Integrations with External Systems

MyDaycare Plus allows the childcare service to activate integrations with external systems, including:

  • government systems;
  • financial institutions;
  • payment services;
  • email services;
  • electronic signature services;
  • applications or application programming interfaces.

When an integration is activated, the childcare service instructs E8C to transmit or receive the information required for the integration to operate.

Only the information required to perform the integration is transmitted.

External systems are operated by independent organizations or providers. Their practices may be governed by their own privacy policies.

10. Artificial Intelligence

MyDaycare Plus may offer artificial intelligence features that can, in particular:

  • analyze data;
  • produce summaries;
  • identify trends;
  • draft text;
  • suggest actions;
  • produce forecasts;
  • answer questions;
  • help users understand certain information.

These features are assistance tools and do not replace the judgment of a qualified person.

When an artificial intelligence feature is used, MyDaycare Plus transmits only the information strictly necessary for the requested analysis or task.

Depending on the feature, this may include:

  • the user’s instructions;
  • information selected for analysis;
  • contextual information required to understand the request;
  • technical information required to operate the feature.

MyDaycare Plus does not automatically transmit all information contained in an account or record when it is not required for the requested task.

Some features may be provided with the assistance of specialized artificial intelligence providers. These providers may process information outside Québec or Canada.

E8C assesses the information transmitted, its sensitivity, the purpose of the processing, security measures, retention practices and the provider’s contractual terms.

Where possible, providers are selected and configured so that childcare service data is not used to train their general-purpose models.

Results produced by artificial intelligence may be inaccurate, incomplete or misinterpreted. They must be reviewed by an authorized user before being used, recorded or communicated.

Artificial intelligence features must not be used as the sole basis for an important decision concerning an individual.

11. Processing Outside Québec

The primary data of MyDaycare Plus is hosted in Québec.

Certain features may nevertheless require limited processing of information by a provider located outside Québec.

This may include:

  • certain integrations;
  • email services;
  • notifications;
  • certain security services;
  • artificial intelligence features;
  • services selected by the childcare service.

Before disclosing information to a provider located outside Québec, E8C assesses privacy-related factors in accordance with applicable requirements.

This assessment considers, in particular, the sensitivity of the information, how it will be used, security measures, contractual protections and the applicable legal framework.

12. Retention of Information

Information is retained for the period required to provide MyDaycare Plus , perform the requested features and comply with applicable obligations.

Information entered by the childcare service is generally retained while the account is active.

The childcare service is responsible for determining the appropriate retention period for its records.

After the Service ends, the childcare service may request an extraction of its data during the period specified in the Terms of Use.

After that period, information may be deleted, subject to:

  • legal obligations;
  • temporary backups;
  • security requirements;
  • the resolution of a dispute;
  • information that E8C must retain for its own obligations.

Information may remain temporarily in backups after it has been deleted from the active system.

13. Security

E8C implements reasonable administrative, technical and organizational measures to protect information processed in MyDaycare Plus .

These measures may include:

  • encryption of communications;
  • access controls;
  • management of roles and permissions;
  • password protection;
  • logging of certain operations;
  • backups;
  • monitoring of security events;
  • restrictions on personnel access;
  • confidentiality obligations;
  • incident management procedures;
  • security updates.

The childcare service must also protect its accounts, devices and credentials and promptly inform E8C if it suspects an incident.

No method of electronic transmission or storage can guarantee absolute security.

14. Privacy Incidents

A privacy incident may include unauthorized access, use, disclosure or loss of information.

When E8C becomes aware of an incident, it takes reasonable measures to:

  • contain the incident;
  • reduce the risk of harm;
  • protect the information;
  • prevent a similar incident from recurring;
  • document the situation.

When E8C processes information on behalf of a childcare service, it informs the childcare service in accordance with applicable obligations.

Where required by law, the individuals and authorities concerned are also notified.

15. Rights of Individuals

Depending on applicable law, an individual may have the right to:

  • access information concerning them;
  • obtain a copy of that information;
  • correct inaccurate or incomplete information;
  • withdraw consent;
  • request that certain uses or disclosures cease;
  • request deletion where permitted by law;
  • receive certain information in a structured technological format;
  • submit observations concerning a decision made exclusively through automated processing;
  • file a complaint.

Requests concerning information contained in a childcare service account should normally be addressed directly to that childcare service.

E8C may provide the childcare service with reasonable assistance to process the request.

Requests concerning information collected directly by E8C , including information related to the customer account, billing or support, may be addressed to E8C ’s Privacy Officer.

16. Cookies and Technical Information

The MyDaycare Plus website and applications may use cookies, session identifiers, local storage and other technologies required to:

  • maintain a session;
  • authenticate a user;
  • save preferences;
  • protect the account;
  • prevent fraud;
  • understand errors;
  • measure performance;
  • improve the Service.

Some cookies are necessary for MyDaycare Plus to operate.

Disabling certain technologies may prevent some features from operating normally.

17. Communications from E8C

E8C may communicate with representatives and users of childcare services to provide:

  • account-related information;
  • security notices;
  • support communications;
  • information concerning the Service;
  • maintenance or interruption notices;
  • subscription information;
  • news about MyDaycare Plus features.

An individual may unsubscribe from promotional communications.

Communications required for account administration, security or operation may continue to be sent.

18. Governance

E8C maintains policies and practices concerning, in particular:

  • personnel roles and responsibilities;
  • access rights;
  • security;
  • retention;
  • destruction;
  • service providers;
  • incidents;
  • requests and complaints;
  • privacy impact assessments;
  • the use of artificial intelligence.

E8C conducts privacy impact assessments where required by law, including for certain new systems, new features and processing outside Québec.

When a request concerns data managed by a childcare service in MyDaycare Plus , E8C may direct the individual to the childcare service concerned.

20. Changes to this Policy

E8C may amend this Policy to reflect:

  • changes to its practices;
  • a new feature;
  • a change of service provider;
  • technological developments;
  • legal or regulatory changes.

The date of the most recent update appears at the beginning of the Policy.

When a material change is made, a notice may be posted on the website, in MyDaycare Plus , by email or at login.

21. Applicable Laws

This Policy is interpreted in accordance with applicable privacy laws, including the laws of the Province of Québec and, where applicable, the federal laws of Canada.

22. Language

This Policy is written in French and translated into English for convenience.

In the event of any discrepancy between the French version and an English or other translated version, the French version prevails, subject to mandatory legal requirements.
